An ex-spouse no longer has to be living full-time in the same home as another person to be engaged in "Cohabitation."
This fairly new law from 2014 defines "cohabitation," or living together, as a mutually supportive, intimate personal relationship "that would be equivalent of a marriage.
Under this fairly new law, a judge may consider eight factors in determining whether cohabitation is occurring. An ex-spouse need not prove all the factors, but at least some of the factors must be there.
(8) Factors That Determine Cohabitation:
1. Intermingled finances
2. Shared responsibility for living expenses
3. Recognition of the relationship in the couple's family and social circle
4. Living together and frequency of contact
5. Shared household chores
6. Whether the alimony recipient has received an enforceable promise
of support from another individual
7. The relationship length
8. Any additional relevant evidence
Note: An ex-spouse does not have to prove all (8) factors, but a judge must consider all (8) in deciding whether the new relationship is the equivalent of a marriage.

I. CHILD CUSTODY
There are two main aspects of Child Custody in New Jersey:
Physical Custody: Where the child/children will spend their time.
Legal Custody: Which parent(s) is/are responsible for decision-making on behalf of the child.
How Courts Determine Child Custody in New Jersey
New Jersey courts consider a number of factors when determining child custody orders, but primarily consider the best interest of the child/children. If the parents are seeking joint custody, the court will examine their ability to agree, communicate, and cooperate with regard to the child/children. Also, any history of domestic violence will figure prominently in any custody or visitation decision. If the non-custodial parent has a history of domestic violence or the court determines a need for precaution, they may be eligible for supervised visitation with their child/children.
Other factors considered when determining child custody in New Jersey may include (but are not limited to)

Types of Child Custody in New Jersey
Joint Custody - Child/Children lives with one parent or alternates between parents, and parents work together when determining medical and educational decisions.
Sole Custody - Child/Children lives with one parent and receives appropriate time with non-custodial parent.
Other Arrangement - Courts determine other custody arrangement to be in the best interest of the Child/Children.
